The new Corporate Manslaughter and Corporate Homicide Act, being implemented in April 2008, will now allow the Health and Safety Executive or the police to prosecute companies who do not comply with their legal obligations seriously.
Under the Health and Safety at Work act 1974 and the 1999 Management of Health and Safety at Work Regulations, companies and organisations must extend a ‘duty of care’ to anyone within the company who drives as part of their duties, whether the vehicle is owned by the company or the driver.
